Please read carefully before using or accessing the website. By accessing the website, you acknowledge and accept the terms outlined below. 

The following Terms of Use (“Terms of Use”) apply to all online interfaces and properties (websites, mobile applications) owned and operated by Accessible Doctors (Accessible Doctors, “we”, “us” or “our”). If you do not agree to the terms of use or any other policies that appear on the site, do not use the service. 

This website should not be used for emergency medical needs. 

Accessible Doctor reserves the right to update or modify the Terms of Use at any time without prior notice. By using this platform following any changes, you are in agreement to follow and to be bound by the terms as changed. For this reason, it is advisable for you to review the Terms of Use whenever you use the site. 

Website Content.

Besides the information you directly receive from a doctor or healthcare professional at Accessible Doctors, the content on the platform should not be considered medical advice. We may post content and links to general information that is of interest to you, but these cannot be taken as medical diagnosis, treatment or advice. The content on the website does not represent or warrant that any particular treatment or medication is safe, effective and appropriate for you. 

You should talk to a qualified doctor or healthcare professional for treatment and diagnosis. 

Electronic Communications
When you use any of our services or send us emails, text messages and other communications electronically from your desktop or mobiles, you consent to receive communications from us electronically. You therefore agree that all agreements can be signed electronically and all notices, disclosures and other communications that we provide electronically satisfies any legal requirement. 

User Accounts 
When you register on the site, you must provide certain information to create an account (“Account”). These include your name, email address, password and other pertinent information. You must be of legal age to create an account and form a binding contract. 

If you are not of legal age, you cannot register to use our services. 

You agree that the information you provide is true, accurate, current and complete. If any of the information is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your account and refuse all current and future service. 

You are responsible for maintaining the confidentiality of the password of your account. You may not transfer or share your account password with anyone, and you can only create one account. An exception is when you have to create a sub-account for children if you are a parent or legal guardian. If you register on behalf of a minor (a person under 18 years old), you are responsible for complying with the terms of use. 

In no event or circumstance shall Accessible Doctors be liable to you for any liabilities and damages resulting from or arising from the use of the site. 

Access Rights 
We hereby grant you limited, non-exclusive and non-transferable right to access the site and use the services for personal and non-commercial use. 

You may not access or use, or attempt to access or use, the site to take any action that could harm us or any third party, interfere with the operation of the Service, or use the Service in a manner that violates any laws. You agree that you will not, and will not attempt to: 
?    Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity or the origin of any information you provide;
?    Use any device, software or routine to interfere or attempt to interfere with the proper working of the site or attempt to probe, test, scan the breach the security or vulnerability of the system or network;
?    Circumvent, reverse engineer, decipher, decompile, disassemble, decrypt, or otherwise alter or interfere or attempt, support or encourage anyone else to engage in such activities with software comprising or in any way make up a part of the service. The use of and distribution of tools designed for compromising security is strictly prohibited. 
?    Engage in the use of unauthorized bots, spiders, crawlers, scrapers or harvest content or information, or use any other unauthorized and automated means to compile information; 
?    Obtain or attempt to gain unauthorized access to computer systems, materials, information and services available through the platform; 
?    Take any action that imposes an unreasonable or large load on our network or infrastructure; 
?    Upload or transmit software, material or communication that contains a virus that can harm our systems or user computers; 
?    Engage in conduct that restricts or inhibits the use of the platform by any person, or that exposes us or any of our users, third parties and affiliates any liability, damage or detriment of any type. 

Service fees and purchase terms and conditions: 

You agree to pay all fees or charges to your account, in accordance with billing terms, fees and charges that come into effect when it is due and payable. As you have authorized Accessible Doctors your credit number or Paypal or eSewa account, you agree that we can have the authority to immediately invoice your account with due and payable fees and charges. No additional consent or authority is required. 
If your health plan, employer or other agency has arranged with us to pay the fee or a portion of the fee, then the fee adjustment is reflected in the fee that you ultimately pay. Check to see if the fee can be reimbursed with your health plan provider, employer or agency. 

If you do not have insurance cover, or if your insurance cover is denied, then you agree and acknowledge that you shall be personally responsible for the expenses incurred. We cannot guarantee that you will receive reimbursement. 

We reserve the right to change or implement a new pricing structure at any time before billing you for initial or future payments due pursuant to these Terms of Use. 

Our services are provided on an appointment basis, and you will be responsible for paying fees or a portion of the fees due to missed appointments. 
If you do not cancel an appointment at least 24 hours in advance, then you, or your insurer or your payor will have to pay for the scheduled services. 

Termination of service 

You may deactivate your Account and end your registration at any time for any reason by emailing support@accessible.doctor. 

We may suspend or terminate your use of the Site, Account or Registration for any reason at any time. In accordance with applicable law, we reserve the right to maintain, destroy, delete any and all communication and materials that are published on our website. After such termination, we will have no further obligation to provide services, except to the extent we are obliged to provide healthcare professionals with your health records to continue care under their applicable legal, ethical and professional obligations to you. 

DISCLAIMER OF WARRANTIES.

YOU EXPRESSLY AGREE THAT USE OF THE SITE OR SERVICES IS AT YOUR SOLE RISK. BOTH THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ACCESSIBLE DOCTORS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

LIMITATION OF LIABILITY.

YOU UNDERSTAND THAT TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL ACCESSIBLE DOCTORS, ACCESSIBLE DOCTORS HEALTH PROFESSIONALS OR THEIR OFFICERS, EMPLOYEES, DIRECTORS, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, STATUTE OR OTHERWISE.
To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law.

Indemnification.

You will indemnify, defend (or settle) and hold harmless Accessible Doctors, healthcare professionals and our officers, directors, employees, agents, subsidiaries, supplier from all claims, actions, proceedings, losses, settlements, judgments, liabilities, suits, damages, disputes or demands, including without limitation any proceeding, investigation or claim by a self-regulatory organization, state or federal securities agency or commission, and including reasonable attorney’s fees and all other costs, fees, and expenses (collectively, "Claims") against any of Accessible Doctors to the fullest extent permitted by law arising out of or in connection with (1) your conduct, provision of content or use of the Site, or such actions by any third party through you, (2) your violation of the rights of another person or party, (3) any Materials provided or made available by you, and (4) any breach or violation by you of your obligations under these Terms of Use. 

Second Consultation/Opinion and Geographical Restrictions.

Second consultation / second opinion services given by Accessible Doctors are privately or freely volunteered services. It provides expert second consultation from a pool of vetted international doctors for consultation on your medical condition and treatment. This is all from the comfort of your home. You do not have to travel anywhere as we will bring the expert consultation to you, ensuring you peace of mind about your health condition is right for you. 
Second consultation/second opinion services are only strictly provided by overseas registered doctors who are authorized by the local medical council and have been approved by local government in coordination with patients’ Primary Care Physicians and relevant patients. 

Doctors and patients consulting overseas doctors understand that both patients and doctors need to adhere to their local country healthcare regulations. Doctors and Patients need to provide their Primary care Physician (PCP) name and details before finalizing the second consultation/second opinion services. We strictly advise consulting with your local registered doctors for Primary consultation and only get the second consultation/ second opinion when you are not being able to find desirable healthcare consultation from local practitioners/allied health professionals. 

Disclosures.

All Health Professionals performing licensed clinical services on the Site hold the professional licenses issued by the professional licensing boards or agencies in the states where they practice. You can report a complaint relating to the care provided by a Healthcare Professional by contacting the professional licensing board in the state where the care was received. In a professional relationship, sexual intimacy is never appropriate and should be reported to the board or agency that licenses, registers, or certifies the licensee.

Any clinical records created as a result of your use of the Services will be securely maintained by Accessible Doctors for a period that is no less than the minimum number of years such records are required to be maintained under state and federal law, which is typically at least six years.

Ownership.

The Site and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection, and arrangement thereof), are owned by Accessible Doctors, its licensors or other providers of such material and are protected by Australian law and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. 
These Terms of Use permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Site. 

Trademarks.

Certain names, logos, and other materials displayed on the Site may constitute trademarks, trade names, service marks or logos ("Marks") of Accessible Doctors or other entities. You are not authorized to use any such Marks without the express written permission of Accessible Doctors. Ownership of all such Marks and the goodwill associated therewith remains with us or those other entities.

Privacy and Communications.

We are required to comply with federal healthcare privacy and security laws and maintain safeguards to protect the security of your health information. Additionally, the information you provide to us during a medical consultation or therapy session is legally confidential, except for certain legal exceptions as more fully described in our Privacy Policy. We devote considerable effort toward ensuring that your personal information is secure. Information regarding our use of health and other personal information is provided in our Privacy Policy.

As part of providing you with the Services, we may need to provide you with certain communications such as appointment reminders, service announcements, privacy notices, administrative messages and other communications about the Services (“Communications”). These communications are considered part of the Services and your Account.

You understand that by checking the “agree” box for these Terms of Use and/or any other forms presented to you on the Site you are agreeing to these Terms of Use and that such action constitutes a legal signature. 
You agree that we may send to you Communications through electronic means including but not limited to: (1) email address that you provided to us during registration, (2) short messaging service (“SMS”) text message to the mobile number you provided us during registration (“SMS Messages”), (3) push notifications on your tablet or mobile device, or (4) by posting Communications on the Site. You can withdraw your consent to receive Communications by deactivating your Account. Information relating to your care, including clinical notes and medical records, are stored on secure, encrypted servers maintained by Accessible Doctors.

SMS Messages Terms and Conditions

The number of SMS messages we send as part of our Communications will depend on the frequency of your use of the Services. 
Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Miscellaneous.

No waiver by Accessible Doctors of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Accessible Doctors to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
Accessible Doctors devotes considerable effort to optimizing signal strength and diagnosis deficiencies but is not responsible for the internet or data bandwidth and signal of your mobile device.
